Copyright
infringement is very serious business: It is a federal
offense punishable by law.
As
noted at the bottom of nearly every page on Diane's website,
you will see the notation, "All photos are copyrighted
and may not be copied or reproduced in any form without permission."
This means that Diane's photos can't be copied, but it also
means that even if you make a star quilt using one of Diane's
patterns, you cannot take a picture of your quilt and sell it
on the internet. This is copyright infringement, and it
applies to all photos on Diane's website. There are some
exceptions, which will be noted on this page.
First,
let's discuss what you CANNOT sell on the internet. Then
we'll talk about what you CAN sell, and how.
*
None of Diane's QUILT PATTERNS or BOOKS can be copied
or reproduced in any way, and there are no exceptions to this
rule. Dian'es NATIVE DESIGN PATTERNS can be copied only for
your personal use and not for any commercial purposes.
*
No QUILTS made with Diane's patterns can be sold
on the internet, even if you take your own photograph of it.
You can't sell it on Ebay or Etsy, or on another online marketplace,
or on yours or someone else's own website. This rule applies
to quilts listed in the "Archives"
section of the website. The "common" star quilts are
not included in this rule, see "What you can sell,"
below, for more information.
Here
is what you CAN sell, and how:
*
Diane has no problem with you displaying a photo of your quilt
on your own personal website or on an internet program that
lets you share personal photos with friends and family-- as
long as you are not SELLING the quilt, and PROVIDING
that you give credit for the pattern to Diane's Native American
Star Quilts. It's always good policy to email and ask first.
Diane has granted 99% of all requests.
*
You may take pictures of any quilt you've made from patterns
or kits that DO NOT have designs in the star. In other words,
if you've made an "ordinary" star quilt without designs
in the star and without a "fancy" border that looks
like one of Diane's, then it's probably OK to post your picture
online. If in doubt about your quilt, just email Diane and she'll
help you clear it up.
* If you make a "fancy star" quilt pictured
in the "Archives,"
or a quilt with some of Diane's Native designs on it, you can
sell your quilt LOCALLY in a brick and mortar store, meaning
that you can have it displayed in a store in your town such
as a crafter's store, and you can also sell it at a powwow or
a fair or another event like this. It CANNOT be pictured
on the internet if it is for SALE, however.
*
Diane will grant permission to schools and non profit organizations
to use one of her quilt photographs for educational purposes,
providing credit is given to Diane's Native American Star Quilts
for its use.
There
have been a few questions raised about what kinds of abuse have
taken place in the past that warrant these copyright pages.
For starters, a lady on Ebay purchased Diane's quilt patterns
and was selling very badly made copies of Diane's quilts on
Ebay at ridiculously low prices. Ebay put a stop to it. Another
time on Ebay, a woman was making cross stich kits using photos
taken from Diane's website. Ebay stopped this too. There have
been many smaller copyright infringements as well-- which all
add up to one big thing.
On
the next page you will find more information about quilt copyrights.
